Make Sure Police Followed Proper Procedures At Your Traffic Stop
At a typical traffic stop, a police officer will ask to see your license and registration, observe your movements outside your car, and ask you to perform field sobriety tests that are supposed to test balance, coordination and mental impairment. You are not legally required to perform these tests.
The officer will often ask you to blow into a device by the roadside. This is a breath test. You are not legally required to perform this test.
If you are arrested, the officer will transport you to a location for your choice of a blood or breath test. If the officer believes you are under the influence of a drug, you may have to take a blood test. Failing to complete these tests is considered a refusal for which the DMV will take your license for one full year. In your criminal court case, a judge can give you additional jail time because of a refusal.
